NVGTN Terms of Service

These Terms of Service, together with the policies referenced in them, govern your access to and use of the NVGTN website, online store, checkout, customer account features, returns portal, SMS program, email program, and any related services operated by NVGTN.
Throughout these Terms, “NVGTN,” “we,” “us,” and “our” refer to NVGTN, LLC, located at 1990 Corporate Center Drive, Trinity, Florida 34655, United States. “You” and “customer” refer to any person who accesses our website, places an order, creates an account, submits a return, submits content, enrolls in marketing communications, or otherwise uses our services.
By accessing our website, placing an order, creating an account, enrolling in our messaging programs, or using any part of our services, you agree to these Terms. If you do not agree, do not use our website or services.
1. Eligibility and Use of the Website
You must be at least the age of majority in your state, province, or country of residence to place an order with NVGTN, or you must use the website with the consent and supervision of a parent or legal guardian.
You agree to use our website, products, and services only for lawful purposes and in accordance with these Terms. You may not use our website or products for any illegal, unauthorized, fraudulent, abusive, or harmful purpose.
We may refuse service, cancel orders, suspend access, deny returns, restrict accounts, or take other appropriate action if we believe you have violated these Terms, abused our policies, submitted false information, engaged in fraud, used bots or automated tools, interfered with our website, or acted in a way that harms NVGTN, our customers, or our operations.
2. Online Store and Shopify
Our online store is hosted by Shopify Inc., which provides the ecommerce platform that allows us to sell products to you. Your use of checkout, payment processing, returns tools, shipping tools, and related ecommerce features may also be subject to the terms and policies of Shopify, payment processors, carriers, app providers, and other third-party services.
3. Account Information and Security
You agree to provide accurate, current, and complete information when creating an account, placing an order, submitting a return or exchange, contacting customer service, or enrolling in marketing communications.
You are responsible for maintaining the confidentiality of your account login information and for all activity under your account. You agree to notify us promptly if you believe your account has been accessed or used without authorization.
4. Product Availability, Limited Drops, and Inventory
NVGTN products may be released in limited quantities, limited-time launches, seasonal drops, preorders, restocks, or exclusive online releases. Product availability is not guaranteed until your order is accepted and processed.
Placing an item in your cart does not reserve inventory. Inventory is only reserved when checkout is completed and your order is accepted.
We reserve the right to limit quantities, cancel duplicate or suspicious orders, restrict purchases by customer, household, account, payment method, shipping address, billing address, IP address, device, or other reasonable identifier, and refuse orders that appear to be placed by dealers, resellers, distributors, bots, automated purchasing tools, or customers attempting to bypass purchase limits.
5. Order Acceptance, Refusal, and Cancellation
After you place an order, you may receive an order confirmation email. That confirmation means we received your order request; it does not guarantee final acceptance, inventory availability, shipment, or delivery.
We may cancel, limit, or refuse any order before shipment for reasons including suspected fraud, payment issues, incorrect pricing, inventory errors, shipping restrictions, duplicate orders, reseller activity, abuse of promotions, website errors, technical errors, or other operational concerns.
If we cancel an order after payment has been captured, we will issue a refund for the canceled portion of the order. Once an order enters fulfillment, we may not be able to modify or cancel it.
6. Preorders, Backorders, and Delayed Shipments
Some products may be offered as preorders, backorders, or delayed-shipment items. If a product is a preorder or delayed-shipment item, we will attempt to identify the expected shipping timeframe on the product page, checkout page, order confirmation, or other customer communication.
Shipping estimates are estimates only and may change due to production schedules, customs delays, carrier delays, inventory issues, high-volume launches, weather, supply-chain disruptions, or other circumstances.
If we cannot ship within a stated shipping timeframe, or if no timeframe is stated and shipment is delayed beyond the period required by applicable law, we may contact you regarding the delay, seek your consent to continue waiting, or issue a refund as required by law.
7. Prices, Promotions, and Errors
Prices, discounts, promotions, product descriptions, images, sizing information, availability, shipping charges, and other website content may change without notice.
We try to display all information accurately, but errors may occur. We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order is submitted. If an order contains a pricing, inventory, promotion, product, or shipping error, we may cancel the order and refund the amount paid.
Promotional codes, discounts, gift offers, and support codes may be changed, limited, suspended, or discontinued at any time. Promotional codes cannot be applied retroactively unless we state otherwise.
8. Affiliate Support Codes
NVGTN may work with affiliates, ambassadors, athletes, creators, or partners who have support codes. Unless specifically stated otherwise, support codes are used to support a particular affiliate and are not discount codes.
Only one support code may be used per order. Support codes may affect commission tracking, attribution, or reporting. We may modify, remove, restrict, or reject support-code usage at any time if we believe there is misuse, fraud, manipulation, technical error, or violation of our affiliate policies.
9. Gift Cards and Store Credit
NVGTN may offer gift cards for sale. Gift cards are redeemable only for eligible purchases from NVGTN and are not redeemable for cash except where required by law. Gift cards should be treated like cash. NVGTN is not responsible for lost, stolen, deleted, misplaced, or unauthorized gift card use, except where required by law.
NVGTN may issue store credit, refund credit, promotional credit, or courtesy credit in certain situations. Store credit is not sold by NVGTN and may be issued as a refund method, accommodation, customer service resolution, promotion, or other discretionary credit.
Store credit is not redeemable for cash except where required by law. Store credit may be tied to the customer account, email address, order, or code to which it was issued. Store credit may be subject to additional terms disclosed at the time of issuance.
Gift cards and store credit may not be used for unauthorized resale, fraud, chargeback abuse, or other misuse. We may cancel, suspend, or refuse gift cards or store credit if we believe they were obtained or used fraudulently, unlawfully, or in violation of these Terms.
10. Payment
By submitting payment information, you represent that you are authorized to use the payment method provided. You authorize NVGTN and its payment processors to charge the full order amount, including product price, shipping, taxes, duties, and any other applicable fees.
If your payment is declined, reversed, disputed, charged back, or flagged as suspicious, we may cancel or delay your order, suspend your account, request verification, deny future orders, or take other reasonable steps to protect NVGTN.
You agree not to submit false chargebacks or payment disputes. This does not limit any rights you may have under applicable law or card-network rules.
11. Shipping, Handling, and Delivery
Shipping options and estimated delivery times may be displayed at checkout. Shipping estimates are provided by carriers such as USPS, DHL, UPS, FedEx, or other providers and are not guaranteed unless expressly stated.
Shipping time begins when the order is accepted by the carrier, not when the order is placed. We usually aim to fulfill orders within 2–3 business days, but fulfillment may take longer during product launches, high-volume periods, holidays, restocks, inventory delays, weather events, carrier disruptions, customs delays, or other circumstances outside our control.
Shipping cost is calculated at checkout based on factors such as destination, shipping method, package weight, package size, and carrier rates.
12. Address Accuracy and Delivery Issues
You are responsible for providing a complete and accurate shipping address at checkout. NVGTN is not responsible for orders delayed, returned, lost, misdelivered, or stolen due to incorrect, incomplete, outdated, or undeliverable addresses provided by the customer.
Once a carrier confirms delivery to the address provided at checkout, NVGTN is not responsible for theft, loss, weather damage, misplacement, or other events occurring after delivery. We may, in our discretion, assist with carrier claims or package investigations, but replacement or refund is not guaranteed.
If a package is returned to us due to an incorrect address, refusal, failure to collect, unpaid duties, customs issues, or carrier issue, we may refund the product amount less original shipping, return shipping, duties, fees, or handling costs, unless otherwise required by law.
13. International Orders, Duties, Taxes, and Customs
International customers are responsible for all customs duties, import taxes, brokerage fees, tariffs, VAT, GST, local taxes, carrier fees, and other charges imposed by the destination country unless checkout expressly states otherwise.
International duties, taxes, customs charges, and carrier fees are not controlled by NVGTN and are not refundable by NVGTN unless required by law. You are responsible for understanding your country’s import rules before ordering.
If you refuse delivery, fail to pay duties or taxes, or the package is abandoned, returned, seized, delayed, or destroyed by customs or the carrier, NVGTN is not responsible for the resulting loss. Any refund will be determined after we evaluate the returned merchandise, fees, shipping costs, and applicable law.
14. EU, UK, and Canadian Consumer Rights
For customers located in the European Union, United Kingdom, Canada, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms is intended to limit any non-waivable rights you may have under applicable law.
For many EU and UK consumer purchases made online, customers may have a statutory right to cancel within 14 days after receiving the goods, subject to exceptions and conditions under applicable law. If those rights apply, you may be required to notify us within the statutory period and return the goods within the required timeframe.
Unless otherwise required by applicable law, customers are responsible for return shipping costs for statutory cancellation returns if we disclosed that responsibility before purchase. We may deduct for diminished value where permitted by law if goods are handled beyond what is necessary to inspect them.
Certain items may be excluded from statutory cancellation rights where permitted by law, including sealed goods that are not suitable for return due to health or hygiene reasons if unsealed after delivery.
Canadian consumer rights may vary by province or territory. Nothing in these Terms limits rights that cannot be waived under applicable provincial, territorial, or federal consumer protection law.
15. Third-Party Shipping Receivers and Freight Forwarders
If you ship an order to a freight forwarder, parcel-forwarding service, mail receiving agency, hotel, warehouse, third-party receiver, or similar service, NVGTN’s responsibility ends once the package is delivered to the address provided at checkout.
NVGTN is not responsible for loss, theft, damage, repackaging, forwarding errors, customs issues, delays, missing contents, or non-delivery after the package is delivered to the third-party receiver. We recommend using reputable forwarding services and purchasing additional insurance through that provider.
Orders sent to third-party receivers may be excluded from certain replacement, refund, or lost-package accommodations.
16. Domestic Returns and Exchanges
Domestic returns and exchanges are accepted only if they comply with our return and exchange requirements.
To start a return or exchange, you must use the NVGTN Returns Center linked on our website or in eligible order communications. If you have multiple orders to return or exchange, each order must be submitted through the Returns Center. You may include multiple approved returns in one package only if each order was properly submitted through the Returns Center and the package uses the return label provided.
For domestic returns, the cost of the return label may be deducted from your refund unless we state otherwise or the return is due to our error. For domestic exchanges, we currently cover the return label and standard shipping for the new exchange item, subject to availability and policy compliance.
All domestic returns and exchanges must be postmarked within 45 days after the order ships.
Returned items must meet all of the following conditions:
- Clothing tags must be intact or included in the package if detached.
- Items must be returned in their original product bags.
- Items must be unworn, unwashed, unused, and not put through the dryer.
- Items must be free of deodorant marks, makeup, self-tanner, stains, bodily fluids, perfume, smoke, pet odor, body odor, abnormal smell, human hair, animal hair, snagging, pilling, excessive wrinkling, or other signs of wear.
- Items must include all original contents, including bra pads, drawstrings, buttons, removable pieces, and packaging components.
- Items must not be damaged, altered, cut, stretched, or modified.
- Items must not be final sale or otherwise excluded from return.
All undergarment sales are final for hygiene reasons unless otherwise required by law.
Original shipping costs are non-refundable unless the return is due to our error or required by law.
If your requested exchange item is unavailable when your return package is inspected or scanned, we may issue a refund instead of completing the exchange. Due to limited inventory, we cannot guarantee exchange availability.
17. International Returns
International customers may return eligible items, but international exchanges are not currently offered.
International returns must be started through the NVGTN Returns Center and must comply with the same item-condition requirements listed in these Terms.
International returns must be postmarked within 45 days after the order ships, unless a longer period is required by applicable law.
Return-label costs, international shipping costs, duties, taxes, customs fees, brokerage fees, and carrier fees are not refundable by NVGTN unless required by law.
18. Return Denials and Biohazard Policy
We inspect returned items before approving a refund, exchange, or store credit. If a return does not meet our policy, we may deny the return.
If a return package contains an item with bodily fluids, biohazardous material, infestation, contamination, or any condition that creates a health or safety concern, our inspection team may stop inspection and deny part or all of the return package. This is for the health and safety of our staff.
Denied returns may be shipped back to the address on file, held for customer instruction, discarded, or otherwise handled according to our safety procedures and applicable law. Additional shipping charges may apply.
19. Refunds, Processing, and Store Credit
Approved refunds will generally be issued to the original payment method unless we issue store credit or another refund method is required or permitted by law.
Refund timing may vary depending on your payment provider, bank, card issuer, payment method, carrier, and our processing volume. NVGTN is not responsible for delays caused by banks, card issuers, payment processors, or other third parties.
If store credit is issued, it may be provided by gift card, account credit, discount code, refund credit, or other method selected by NVGTN.
20. Defective, Damaged, or Incorrect Items
If you believe you received a defective, damaged, or incorrect item, contact us at contact@nvgtn.com within 14 days after delivery with your order number, photos, and a description of the issue.
We may request additional information, photos, video, or return of the item before determining whether a refund, replacement, repair, store credit, or other remedy is appropriate.
Normal variations in fit, color, fabric, measurements, dye lots, manufacturing tolerance, screen display, lighting, compression, stretch, or customer preference are not automatically considered defects.
This section does not limit any rights you may have under applicable law that cannot be waived.
21. Product Material, Sizing, and Fit
We work to maintain consistent quality, materials, sizing, and fit across production runs. However, apparel manufacturing may result in reasonable variations in measurements, compression, stretch, color, dye, feel, opacity, and fabric performance.
Certain items, especially seamless products, may have a reasonable production tolerance. Fit and opacity can vary depending on size selected, body shape, fabric color, how the item is worn, and lighting conditions. NVGTN leggings are not guaranteed to be “squat-proof” in every color, size, lighting condition, or use case.
If you need sizing help, contact customer service before purchasing.
22. Product Use, Tags, and Packaging Safety
NVGTN products are intended to be used as apparel for ordinary personal use. You are responsible for using products safely, appropriately, and for their intended purpose.
Use caution when opening packages, removing tags, cutting plastic fasteners, unpinning safety pins, handling drawstrings, and disposing of bags or packaging materials. Packaging, small parts, tags, fasteners, strings, and similar items may create choking, suffocation, puncture, or injury risks, especially around children and pets.
Keep all packaging, bags, tags, fasteners, and small parts away from children. Report product or packaging safety concerns to contact@nvgtn.com.
23. Intellectual Property
The NVGTN name, logos, marks, designs, product names, images, videos, website content, graphics, text, software, layout, and other materials are owned by NVGTN or our licensors and are protected by intellectual property laws.
You may not copy, reproduce, distribute, sell, resell, exploit, scrape, modify, reverse engineer, create derivative works from, or use any NVGTN intellectual property without our prior written permission.
Nothing in these Terms grants you ownership of or rights in NVGTN intellectual property.
24. User Content, Reviews, Feedback, and Submissions
If you submit reviews, photos, videos, comments, social media posts, tags, ideas, feedback, suggestions, designs, proposals, or other content to NVGTN, you represent that you own or have permission to submit that content.
By submitting content to us, tagging us, using NVGTN hashtags, or otherwise making content available to us, you grant NVGTN a worldwide, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, publish, display, distribute, edit, crop, modify, translate, and create derivative works from that content for marketing, advertising, social media, website, email, product, and business purposes, unless prohibited by law.
You agree that your submissions will not violate any rights of another person, including copyright, trademark, privacy, publicity, or other personal or proprietary rights. You are responsible for your submissions and their accuracy.
We may monitor, edit, remove, or refuse user content at our discretion.
25. Prohibited Uses
You may not use the website, services, or products to:
- Violate any law or regulation.
- Infringe our rights or the rights of others.
- Submit false, misleading, fraudulent, or inaccurate information.
- Harass, abuse, threaten, defame, discriminate, or harm others.
- Upload viruses, malware, malicious code, or harmful content.
- Interfere with website security, checkout, inventory, payment systems, or operations.
- Use bots, scrapers, crawlers, automated purchasing tools, or similar systems.
- Resell products commercially without authorization.
- Circumvent quantity limits, fraud controls, launch restrictions, or security features.
- Abuse returns, exchanges, chargebacks, promotions, support codes, gift cards, store credit, or customer service.
- Collect or track personal information of others.
- Spam, phish, pharm, pretext, spider, crawl, scrape, or otherwise misuse the website.
- Use the website for any obscene, immoral, unlawful, or unauthorized purpose.
We may terminate access, cancel orders, deny returns, suspend accounts, or take other action if we believe these Terms have been violated.
26. Third-Party Links and Tools
Our website may include links to third-party websites, tools, apps, payment processors, shipping providers, social media platforms, review tools, returns portals, or other services we do not control.
We are not responsible for third-party websites, tools, content, policies, practices, products, services, delays, errors, or damages. Your use of third-party services is at your own risk and may be governed by those third parties’ terms and privacy policies.
27. Privacy
Your submission of personal information through the website, checkout, customer account, returns portal, SMS program, email program, or other services is governed by our Privacy Policy, available through our website footer or other posted location.
By using our services, you acknowledge that you have reviewed our Privacy Policy.
28. Email and Marketing Communications
By providing your email address, you may receive transactional emails related to orders, shipping, returns, account activity, customer service, and similar operational matters.
You may also receive marketing emails if you subscribe, create an account, make a purchase where permitted by law, or otherwise consent. You can unsubscribe from marketing emails by using the unsubscribe link in the email. Transactional emails may still be sent as necessary to process orders or provide customer service.
29. SMS Messaging Terms
By opting into NVGTN text messages, you agree to receive recurring automated marketing and informational text messages from NVGTN at the mobile number you provided or otherwise designated. Consent to receive marketing text messages is not a condition of purchase.
Message frequency varies. Additional messages may be sent based on your interaction with NVGTN. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
You may cancel SMS messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT, or by otherwise contacting us in a reasonable manner. After you send an opt-out request, we may send one confirmation message that you have been unsubscribed. After that, no further marketing text messages will be sent unless you opt in again.
You may reply HELP for help or contact us at contact@nvgtn.com.
You agree to notify us if you change, transfer, or stop using the mobile number you provided. You can do this by replying STOP from the original number or contacting contact@nvgtn.com.
We will honor opt-out requests within the timeframe required by applicable law. We may change, suspend, or terminate our messaging program at any time.
30. Disclaimer of Warranties
The website, services, content, and products are provided on an “as is” and “as available” basis, except as expressly stated by NVGTN or required by law.
To the fullest extent permitted by law, NVGTN disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, durability, and uninterrupted operation.
We do not guarantee that the website will be secure, uninterrupted, timely, error-free, or free of viruses or harmful components.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
31. Limitation of Liability
To the fullest extent permitted by law, NVGTN and its owners, officers, directors, managers, members, employees, affiliates, contractors, suppliers, vendors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, business interruption, or similar damages.
To the fullest extent permitted by law, NVGTN’s total liability for any claim related to your use of the website, services, or products will not exceed the amount you paid to NVGTN for the product or order giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
32. Indemnification
You agree to indemnify, defend, and hold harmless NVGTN and its owners, officers, directors, managers, members, employees, affiliates, contractors, suppliers, vendors, service providers, and licensors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, misuse of the website or products, violation of law, infringement of third-party rights, fraud, chargeback abuse, return abuse, or submitted content.
33. Informal Dispute Resolution
Before either party initiates arbitration or a court proceeding, the party asserting a claim must first send written notice describing the claim and requested relief.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after notice is received, unless immediate relief is necessary to prevent harm or applicable law requires otherwise.
34. Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the fullest extent permitted by law, you and NVGTN agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, products, orders, marketing communications, SMS messages, emails, returns, exchanges, gift cards, store credit, customer service, or any relationship between you and NVGTN will be resolved by binding individual arbitration rather than in court.
This arbitration agreement is governed by the Federal Arbitration Act.
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, unless the parties agree otherwise or applicable law requires a different forum.
The arbitration will take place in Pasco County, Florida, unless the arbitration provider’s rules or applicable law require otherwise. The arbitrator may award the same individual relief that a court could award, subject to these Terms.
Either party may bring a qualifying claim in small claims court. Either party may also seek temporary or preliminary injunctive relief in court to protect intellectual property, confidential information, website security, account integrity, or against unauthorized resale, fraud, or misuse.
35. Class Action Waiver
To the fullest extent permitted by law, you and NVGTN agree that each party may bring claims only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, private attorney general, mass arbitration, or representative action.
The arbitrator may not consolidate claims of multiple customers or preside over any class, collective, consolidated, representative, or mass proceeding, unless both you and NVGTN agree in writing.
If any part of this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request for relief may be severed and handled in court, while the remaining claims must proceed in arbitration to the fullest extent permitted by law.
36. Arbitration Opt-Out
You may opt out of the arbitration agreement by sending written notice to contact@nvgtn.com within 30 days after your first acceptance of these Terms.
Your opt-out notice must include your full name, email address, mailing address, order number if applicable, and a clear statement that you opt out of arbitration. Opting out of arbitration will not affect any other part of these Terms.
37. Governing Law and Venue
These Terms and any dispute between you and NVGTN are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where federal law applies or applicable consumer law requires otherwise.
If any dispute is not subject to arbitration, the parties agree to the exclusive jurisdiction and venue of the state or federal courts located in or serving Pasco County, Florida, unless applicable law requires otherwise.
38. Force Majeure
NVGTN will not be responsible for delays or failures caused by events outside our reasonable control, including carrier delays, labor disruptions, supplier delays, customs delays, weather, natural disasters, pandemics, acts of war, terrorism, cyberattacks, power outages, payment-processing failures, platform outages, government action, supply-chain disruptions, or other force majeure events.
39. Changes to These Terms
We may update or replace these Terms at any time by posting a revised version on our website. The updated Terms will be effective when posted unless stated otherwise.
Your continued use of the website or services after changes are posted means you accept the updated Terms. The version in effect at the time of your order will generally apply to that order unless otherwise required by law.
40. Severability
If any part of these Terms is found unlawful, void, or unenforceable, that part will be enforced to the fullest extent permitted by law or severed, and the remaining Terms will remain in effect.
41. No Waiver
Our failure to enforce any part of these Terms is not a waiver of our right to enforce that or any other part of these Terms later.
42. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. NVGTN may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, change of control, financing, reorganization, or by operation of law.
43. Entire Agreement
These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, SMS Terms, and any other policies referenced on our website, constitute the entire agreement between you and NVGTN regarding your use of the website, services, and purchases from NVGTN.
